Terms of Service

1. Agreement

BESSlayoutis operated by Tetsu Energy (“we”, “us”). These terms govern your use of the BESSlayoutwebsite, layout tool, and related services (the “Service”). By using the Service or creating an account, you agree to these terms. If you use the Service on behalf of a company, you agree on its behalf and confirm you have authority to do so. If you do not agree, do not use the Service.

2. Accounts

You must give accurate information when you create an account and keep your sign-in credentials secure. Accounts are for one person and may not be shared. You are responsible for activity under your account.

3. Acceptable use

You may not, and may not help anyone else to:

• use the Service, or any output, data, or knowledge obtained from it, to build, improve, train, or market a product or service that competes with BESSlayout;
• to the extent permitted by applicable law, access the Service to monitor its features, performance, or functionality for competitive purposes, or publish benchmarks or comparisons of the Service without our prior written consent;
• copy, modify, decompile, disassemble, or reverse engineer any part of the Service, including the layout solver code delivered to your browser, or attempt to derive its source code, algorithms, or rules, except where applicable law expressly permits it despite this restriction;
• access the Service by automated means (bots, scrapers, scripts) or extract layouts, figures, or content in bulk;
• remove watermarks, bypass plan limits or paywalls, or interfere with the security or operation of the Service;
• resell, sublicense, or provide the Service to third parties as a service of your own;
• use the Service in violation of any law.

4. Your content

Site boundaries, settings, and layouts you create remain yours. You grant us a limited license to store and process them to operate, support, and improve the Service, as described in our Privacy Policy. You may use the layouts you export for your own projects, subject to your plan.

5. Our property

The Service, including its software, solver, layout rules, designs, documentation, and content, is owned by us and protected by intellectual property laws. Except for the right to use the Service under these terms, no rights are granted to you.

6. Paid plans

Paid plans are billed in advance through our payment processor and renew until canceled. You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.

7. Engineering responsibility

Layouts produced by the Service are preliminary design studies. They are not engineering drawings and do not replace review by qualified engineers, equipment manufacturers, the authority having jurisdiction, or compliance with applicable codes and standards. You are responsible for verifying any layout before relying on it.

8. Disclaimer and limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of results. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim.

9. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these terms, including the acceptable use rules in section 3. You may stop using the Service and delete your account at any time.

10. Changes

We may update these terms. The date at the top shows the latest version. Continued use of the Service after a change means you accept the updated terms.

11. Severability

If any provision of these terms is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
